The World’s Best Joke Contest
SPONSOR Sponsor is The Reader’s Digest Association, Inc. (“Sponsor” or “Sponsor”).
CONTEST DESCRIPTION This Contest is an international skill based contest in which the “Best Joke in the World” will be selected from among the winners of 32 separate local Best Joke Contests conducted by Sponsor in various countries (as more fully described below)The winner will receive a prize as detailed in these Official Rules.
THE LOCAL CONTESTS During the period between August 18, 2009 and September 18, 2009, Sponsor has conducted a local contest in each of the following countries/territories ( the “Local Contests”) in which one joke was selected as the Best Joke in the Local Contest. and the entrant who submitted that Joke was declared the Local Contest Winner. was conducted in accordance with and subject to the Official Rules governing that Local Contest which among other provisions, provided that the Local Contest Winner would be entered in this International Contest to select the Best Joke in the World. Local Contest Winners have been selected in Argentina, Australia, New Zealand, South Africa, Netherlands, Belgium, Brazil, Canada, China, Croatia, The Czech Republic, Finland, France, Germany, Hungary, India, Indonesia, Korea, Mexico, Norway, Poland, Portugal, Romania, Russia, Serbia, Slovenia, Spain, Sweden, Switzerland, Thailand, The United Kingdom, The United States.
ELIGIBILITY This Contest is open only to the 32 Local Contest Winners. Local Contest Winners must have satisfied all the eligibility requirements of their Local Contest and must not be an Employee of Sponsor, and its subsidiaries and affiliates, or their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live). THIS CONTEST IS VOID WHERE PROHIBITED.
ENTRY Local Contest Winners will (subject to meeting the Joke and Eligibility requirements set forth in these Official Rules) automatically be entered into the Contest with the winning Joke from the Local Contest. (The “Joke” together with the Entrant’s name, likeness, biographical and/or any other material submitted shall be referred to as the “Entry”). The sponsors of each Participating Local Contest (the “Local Contest Sponsors”) will automatically submit the winning Joke to Sponsor for entry into this Contest. No responsibility is assumed for lost, late or misdirected Entries or for the failure of the Local Contest Sponsor to submit a Local Contest Winner’s joke into this Contest. This Contest is closed to all other participants.
ENTRY REQUIREMENTS The winning jokes from the 32 Local Contests will be automatically entered into this Contest, provided they meet all entry requirements stated in these rules. The Joke must not be lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous or otherwise inappropriate or objectionable, as determined by the Judges and/or Sponsor in their sole and absolute discretion. Sponsor reserves the right in its sole and absolute discretion to disqualify any entry that it believes fails to comply with this or any other provision of these Official Rules notwithstanding the fact that the entry was selected as the Local Contest Winner. The entry must not infringe the copyright, trademark, privacy, publicity or other intellectual property rights of any person or entity. Entries submitted in geographic areas in which the entry is not permissible will be disqualified. All entries become the property of Sponsor. Sponsor reserves the right to use each Entry in all print and electronic media, and to edit it for brevity and clarity.
WINNER SELECTION Judging: All eligible winning jokes from the 32 Local Contests will be posted online at readersdigest.com. Members of the public are invited to review and vote for their favorite joke. The Joke that receives the most votes during the Voting Period will be the potential Winner subject to verification and compliance with these Official Rules.
PRIZES 5. Prize(s): The winner of this Contest (the “International Winner”) will receive $1,000.00, to be paid in U.S. currency. All taxes, if any, on the Prize are the International Prize Winner’s responsibility. The prize is guaranteed to be awarded. No transfer, assignment or substitution of a prize permitted. International Winner will be notified by email and regular mail within 4 weeks of the closing date.
INTERNET Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Sponsor is not responsible for theft or destruction or unauthorized access to or alterations of votes, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Sponsor is not responsible for inaccurate transmissions of or failure to receive votes by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof, except to the extent that any death or personal injury is caused by the negligence of the Sponsor. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, disruption or termination of the Contest site for any reason or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest. Sponsor reserves the right at its sole discretion to immediately cancel, terminate, modify or suspend the Contest. Sponsor reserves the right to terminate or modify the Contest at any time for any reason. In such a circumstance, Winner will be selected based on votes received to date of termination.
CONDITIONS OF PARTICIPATION.
Submission of Entry into this Contest constitutes Entrant’s agreement to be bound by the terms of these Official Rules and by the decisions of the Judges and/or Sponsor, which are final and binding on all matters pertaining to this Contest. Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Potential winner may be required to sign and return an Affidavit of Eligibility/Liability & where legally permissible, a Publicity Release within fourteen (14) days following the date of first attempted notification. Failure to comply within this time period may result in disqualification and selection of an alternate winner. By submitting an Entry, Entrant irrevocably grants Sponsor an unlimited, worldwide, perpetual, license and right to publish, use, copy, and publicly display the Entry in any way, in any and all media, including without limitation for advertising and promotional purposes, and without compensation to the Entrant. Acceptance of Prize constitutes permission for, and winner’s consent to Sponsor to use the winner’s name, likeness and/or Entry, in whole or in part for advertising and promotional purposes, unless prohibited by law. Entrants consent to the Sponsor doing or omitting to do any act that would otherwise infringe the entrant’s “moral rights” in their submission. To the extent permitted by law, entrants agree to hold Sponsor and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives (“Released Parties”) harmless from any injury or damage caused or claimed to be caused by participation in the Contest and/or use or acceptance of any prize won, except to the extent that any death or personal injury is caused by the negligence of the Sponsor. Released Parties are not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize. An Entrant may be prohibited from participating in this Contest if, in the Sponsor’s sole discretion, it reasonably believes that the Entrant has attempted to undermine the legitimate operation of this Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other Entrants, the Sponsor or associated agencies.
NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and any Entrant expressly waives any and all such rights. In the event that a court of competent jurisdiction finds the foregoing waiver unenforceable, Entrants agree that this Contest shall be subject to and governed by and subject to the laws of the state of New York and the forum for any dispute shall be in New York, United States of America. DATA PRIVACY: Entrants agree that personal data, especially name and address, may be processed, stored and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor in order to check Entrants’ identity, their postal address and telephone number, or to otherwise verify their eligibility to participate in the Contest. Entrants have a right to access, review, rectify or cancel any personal data held by the Sponsor by writing to The Reader’s Digest Association, Inc. WARRANTY AND INDEMNITY: Entrants certify that they have the right to enter their entry in the Contest. Each Entrant agrees not to submit any entry that (1) infringes any 3rd party intellectual property, personal rights or other rights, including without limitation, copyright, trademark; (2) includes any personally identifiable information or (3) otherwise violates applicable law in any countries in the world. To the maximum extent permitted by law, each Entrant indemnifies and agrees to keep indemnified the Sponsor at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each Entrant indemnifies and agrees to keep indemnified the Sponsor at all times from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which the Sponsor will or may become liable by reason of or related or incidental to any act, default or omission by an Entrant under these Official Rules including without limitation resulting from or in relation to any breach, non-observance, act or omission whether negligent or otherwise, pursuant to these official rules by an Entrant.
SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
