I am so happy this family was able to get their child back and their lives in order. The justice system prevailed!
For all parents out there involved with DCFS/CPS, please do not plead up to false charges. It will NOT get your children back!
CPS took our only 8 months old baby away to foster care from hospital and I'm (father) is the suspect by the police as they do not believe my baby can be injured by falling from bed (20" inch height). During follow up x-rays with my baby, a Dr. noticed my wife might have OI symptom and genetically my baby got that (he is 90% sure by looking).Now we waiting for DNA test for my baby. A pre-trial date on Oct 14, 09. CPS kidnapped my baby w/o looking our 100% clean background. we are minority parent
Guys, this outcome for the Velasquezes is very nontypical. Most peoplewho don't admit to wrongdoing or plead no contest to DCFS when there are broken bones, etc. never get their child(ren) back.
We are currently going through this and feeling very powerless. My son took his 2 mon old (twin) to the ER bc he just knew something wasn't right. They first said nothing wrong. My son insisted on more xrays and then next thing he knew, the police were called and he was told the baby had multiple fractures that could only be caused by child abuse -- there were no bruises or any other trauma. Child Welfare took him and his twin (who checked out 100% okay) same day. We need help.
Doctors are trained to never make accusations or figure out who inflicted trauma. Our job is simply to raise the flag of concern if there is even a chance that an injury may have been inflicted. CPS and law enforcement are tasked with evaluating the "who" question, if the child is safe, & pressing charges if there is proof of crime. The inflammatory dramatization in the article is infuriating. The author never gives an explanation for the injuries. What if someone else harmed this child?
OI is rare, but is well-known amongst healthcare workers & always considered for abnormal fractures. I am not suggesting this happened with the Velasquez family, but children with OI can also be abused. Type I OI is very mild and often still requires forceful impact to cause fracture. Many with T-1 never fracture. If fractures can't be explained by normal handling, inflicted trauma must still be considered. I doubt the doctors were the villians here. CPS/foster care need more public support!
As a parent, my heart goes out to the Velasquez family. I also have to say this article is incredibly inaccurate, unfair and potentially dangerous. As a physician, I have unfortunately taken care of children who have been critically injured or killed by abuse after previous suspicious episodes went unreported. Law requires us to report even without proof, and often admit to the hospital for safety.This is critical to ensure we never miss the opportunity to save a child. CPS takes over from there
